Government
Section
1. The business and property of the Association,
except as otherwise provided by Federal, State or County statute or these
by-laws, shall he directed and authorized by the members as provided by the
by-laws, as adopted and/or amended by the BBCA. In the absence of membership
authorization or direction by the membership, the business, property, and
interests of the BBCA shall he conducted and managed by the BBCA Board of
Directors. The Board shall be guided by the actions, concerns, and positions
established by the membership. Any issue of policy or precedent that has not
been established by the membership shall be taken up by the Board, whenever
possible. The BBCA President shall assign the responsibility for carrying
out any resolution or instruction as may he passed by the BBCA membership
at any regular meeting or special meeting.
Section
2. The Board of Directors shall consist of
the Officers of the BBCA (President, Vice President, Secretary, Treasurer)
and four more Board members.
a.
The Board shall elect BBCA Board members to serve as President, Vice President,
Secretary, and Treasurer and hold office for a term of twelve (12) months.
Elections shall be held at the first Board meeting of each calendar year.
b.
All officers shall be eligible for more than one term. However, service
in the office of President or Vice President shall be limited to four
(4) consecutive terms.
c.
Any Officer or Director who fails to attend the Board and/or membership
meetings regularly may he forced to resign by a two-thirds (2/3) majority
vote of the Board present at the meeting. Board members forced to resign
may appeal only to the Board. The Board vote will he final.
Section
3. The officer and their duties are as follows:
President
- The
President shall preside at all meetings of the BBCA.
- The
President shall decide all questions or disputes not controlled by the
by-laws of the BBCA.
- The
President’s vote shall prevail in case of a tie vote on any matter being
considered by the BBCA Board.
- The
President is authorized to sign checks drawn on BBCA funds.
- The
President shall appoint committee chairpersons, and serve as an ex-officio
member of all committees.
- The
President shall appoint members to fill vacancies on the hoard until
the next regular election.
- The
President shall install all other newly elected officers and board members.
- The
President shall he bonded in such amount as prescribed by the Board
and the premium shall he paid by the BBCA.
- The
President shall head an Audit committee which will audit the financial
hooks of the BBCA in January of each year and report those findings
at the first annual general membership meeting.
Vice President

The Vice President shall preside at all meetings in the absence of the
President.
- The
Vice President shall become the President in the event of the death
or resignation of the President until the next regular election of officers.
Secretary
- The
Secretary shall keep true, full, and correct record of all membership
and Board meetings.
- The
Secretary shall give notice of Special meetings to all members as described
in Article 4.
- The
Secretary shall preserve all papers and documents pertaining to the
office.
- The
Secretary shall deliver all papers, documents, and property belonging
to the association to the successor of the office.
- The
Secretary shall make any and all recorded information available to any
member if the request is in writing.
- The
Secretary shall prepare and mail the BBCA election ballots each year.
- The
Secretary shall retain a sign-in sheet of all members attending meetings.
- The
Secretary shall present the prior general membership meeting minutes
for approval.
Treasurer
- The
Treasurer shall receive all funds due the BBCA.
- The
Treasurer shall keep current a list of members in good standing as provided
by the County.
- The
Treasurer shall make a financial report at all meetings.
- The
Treasurer shall keep all financial hooks and records of the BBCA ready
for audit at all times. No audit, except the yearly Audit committee
audit, shall be done without a written request. Requests must he honored
within 31 days.
- The
Treasurer shall require and maintain a receipt for any cash disbursement.
- All
funds received by the BBCA shall he deposited in Board approved accounts.
- All
financial books and property of the BBCA shall he surrendered by the
outgoing Treasurer to the President.
- The
Treasurer shall serve on the Harbor Committee.
Section
4. There are two types of committees, standing
and special. Chairpersons of both types of committees shall be appointed by
the President, with the concurrence of the Board. The committees and chairpersons
shall serve until the special committee is dissolved by the President, or
standing committee successors are appointed by the President.
Standing
Committees
Beach
Committee
- This
committee of five (5) members in good standing, appointed by the Board
of Directors, shall have charge of all leased beach areas at Beverly
Beach. This includes the waters, jetties, cement piers, and floats.
- The
Beach Master, appointed by the President of the BBCA, shall chair this
committee and shall have authority to eject anyone found not complying
wit the Beach Area posted rules.
Harbor
Committee
-
This committee of five (5), appointed by the Board of Directors, shall
recommend, organize and oversee any maintenance, repairs, and improvements
to the wooden piers, docks, bulkheads, and ramps.
- This
committee shall recommend Rules and Regulations of the Boating Access
Areas for the BBCA membership approval.
- This
committee shall make yearly recommendations to the Board concerning
slip fees.
- The
Harbor Master, who is appointed by the President of the BBCA, shall
chair this committee. The Harbor Master shall administer boat slips
and ramp keys and enforce the rules and regulations of the water access
areas.

Slip fees shall he paid directly to the Treasurer of the BBCA. The Treasurer
shall report the receipt of slip tees to the Harbor Master by May 1
in each year that slip fees are due.
Neighborhood
Watch Committee
- This
committee is responsible for recommendations about the security and
safety of the BBCA community.
- This
committee is responsible for the nightly patrols within the BBCA community.
- This
committee is the liaison between Lay Enforcement Agencies and the BBCA.
- This
committee shall he chaired by the Neighborhood Watch Captain, who will
he appointed by the President of the BBCA. This Watch Captain will he
responsible for assuring the committee follows the guidelines set up
by the Law Enforcement Agencies.
